Thanks to all involved. Interesting stuff. Now that I have had some more time to read and think about this…
I personally don’t care about whether Latvia retains or ever gets back Abrene. Seems as few people outside of the gaismas pils in the sky inhabitants do. Which side of the physical border of Latvia Abrene falls shouldn’t really be the issue. The only issue that should matter is the continuation of Latvia’s Republic back to the original declaration of independence. What I still do not understand is why the rush to sign the treaty at this point? Is there some deadline that needs to be met? EU pressure? Also, if Abrene is the only bone of contention and that is what keeps sticking in Russia’s craw, why not formally cede Abrene to Russia, in whatever form they’d see fit, in return for Russia recognizing the 1920 treaty. Isn’t that what this is all about in a nutshell? Treaties can be and do get amended all of the time.
A referendum on Latvia’s borders is a stupid idea. As far as I know no nation decides these type of things by popular vote. Even most constitutional issues are usually resolved either through the courts or the legislature. Putting these type of issues to a popular vote is nothing more than a populist stalling technique and absolute abbrogation of political duty and responsability.
One thing in Ojars position still bugs me. I have no problem with political pragmatism, but successful nations are built on systems of law. Law is the backbone of civilized societies. Its far too easy to dimiss criticism as legal nitpicking. Like it or not law often is all about nitpickin. That’s why they get writen. If we could avoid nitpicking without them we wouldn’t need them. Often a biding legal decision can hang on a very nuanced point. In the past few years, at least from my perspective, Latvia has treated law as if it was nothing more than a series of really, really good ideas that one may or may not follow depending on convenience. Laws should never be about convenience. The pride parade as a case in point. Its a slippery slope and the cynic in me can’t shake the feeling that here we go again.
